Terms of Use
Last updated 21 September 2026. These terms govern your use of ScaleCaller at scalecaller.pro. By creating an account or using the product, you agree to them.
1. Who we are
ScaleCaller is a software product for Indian website, ads, and Google Business Profile agencies. It helps you find local businesses, keep a call desk, and (on paid Pro and Agency plans) place hosted click-to-connect calls. We sell a tool. We are not your telemarketer of record, and we do not make the calls for you.
2. The service
ScaleCaller lets you search public Google listing data through the official Places API, unlock leads into a CRM card, log notes and statuses, open WhatsApp, schedule callbacks, and — if your plan includes it — start an Exotel click-to-connect call that rings you first, then the prospect. After hangup, a recording may be transcribed (Sarvam Saaras, with AssemblyAI as fallback) and a next action written on the card.
There is no AI voice agent on the call. You speak. The product is built for India at launch. We may refuse or limit accounts that are clearly not using it for Indian local-business prospecting.
3. Accounts
You must give accurate details, keep your password safe, and be old enough to enter a contract in India. One person or agency owns the workspace. You are responsible for activity under your login, including teammates you invite later.
4. Your calling is your responsibility
You decide who to call, what to say, and whether a number is appropriate. TRAI rules, the TCCCPR, DND, and other Indian telemarketing and data laws still apply to you. Public Google listing numbers are not a licence to spam. If a shop asks you to stop, mark them opted out and do not call again. ScaleCaller may store that opt-out so the desk does not forget; it does not replace your own compliance process.
5. Recordings
Hosted calling may record the conversation so we can transcribe it for your lead card. You must tell the other party that the call is recorded, in line with applicable law. Do not use ScaleCaller to record secretly. We keep audio for a limited time; see the Privacy Policy.
6. Acceptable use
Do not:
- scrape Google Maps or any other source through or around the product
- blast personal mobiles, DND-registered numbers, or purchased spam lists
- use the desk for fraud, harassment, phishing, or impersonation
- try to put an AI voice agent on the hosted call
- probe, overload, or reverse-engineer the service
- resell access except as we expressly allow for Agency seats
We may suspend or close an account that breaks these rules.
7. Plans, free desk, and billing
An unpaid account can use the free desk: Scout search, 50 one-time lead unlocks, CRM, WhatsApp on the card, and the callback calendar. Hosted calling and transcripts stay locked until you pay for Pro or Agency. Paid Starter, Pro, and Agency are monthly subscriptions billed in INR through Razorpay. Prices on the site are GST-inclusive.
You can cancel from the billing page. Payments are not refundable — including the first month. See the Refund Policy. Usage-based overage, if billed, is not refundable once consumed. We may change plan prices with notice; the new price applies on the next renewal.
8. Listing data
Prospect name, address, phone, website, and rating come from Google Places. Google’s terms still apply to that data. Listings can be wrong, duplicate, or stale. Unlocking a lead does not mean the business wants your pitch, and it does not give you the owner’s personal mobile unless a later licensed enrichment product says otherwise.
9. Intellectual property
ScaleCaller, the logo, and the product UI are ours. Your scripts, notes, and customer relationships stay yours. You grant us a limited licence to host that content only to run the service for you.
10. Availability and disclaimers
Telephony, transcription, search, and billing depend on third parties (including Exotel, Sarvam, Google, Supabase, and Razorpay). We aim for a reliable desk, not a guaranteed uptime SLA at launch. The product is provided “as is.” We do not promise meetings, revenue, or that a particular shop will pick up.
11. Liability
To the extent Indian law allows, ScaleCaller is not liable for lost profits, lost data, or indirect damages, or for how you use the calling features. Our total liability for a claim is capped at the subscription fees you paid us in the three months before the claim. Nothing here limits liability that cannot be limited by law, including fraud.
12. Governing law
These terms are governed by the laws of India. Courts in India have exclusive jurisdiction, except that we may seek injunctive relief anywhere to protect the service.
13. Changes
We may update these terms. The date at the top will change. Continued use after an update means you accept the new terms. If a change is material, we will try to email the address on your account.
